The petitioner seeks bail in Simri P.S. Case No. 20 of 2018 instituted for the offence under Section(s) 467, 468, 471, 409, 420 and 120B/34 Indian Penal Code.
Learned counsel for the petitioner has submitted that in the written report there is no any specific allegation that amount has been defalcated by this petitioner. In the written report it is alleged that petitioner was appointed as operator of S.B.I. customer Service point Shivdhara by Bihar Sanjivini Foundation and has opened account in the name of Suman Kumar Jha in the S.B.I. customer service point Shivdhara and government funds in connection with different welfare schemes was being deposited in the said bank account was later on withdrawn. Patna High Court Cr.Misc. No.48523 of 2018(5) dt.25-09-2018 2/2 mentioned in the written report that complaint was made by the aforesaid Suman Kumar Jha but in the written report there is no any specific allegation with respect to amount which has been misappropriated by the petitioner.
Learned counsel for the State has submitted that bank account of other persons were also opened by the petitioner wherein various government funds were received and withdrawn which has come in the case diary. As such, it appears that there is allegation that petitioner got opened account of several persons but there is no any allegation of misappropriation of the money against this petitioner.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga, in connection with Simri P. S. Case No. 20 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
