JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 Petitioner seeks bail in connection with Barauni (FCI) P.S. Case No. 266 of 2019 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code. As per FIR accused persons, including the petitioner had taken son of the informant with them and later on his dead body was found.
Submission of learned counsel for the petitioner is that except last seen along with the deceased there is nothing against him and he is in custody since 2.7.2019. It is further submitted that similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court by order dated 17.12.2019 passed in Cr.Misc.No. 72801 of 2019. Heard learned APP, who has opposed the prayer for
Patna High Court CR. MISC. No.74972 of 2019(3) dt.23-01-2020 2/2 bail stating that there is self confession of the petitioner, whereas there is no other confessional statement of co-accused and petitioner was last seen with the deceased. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, once charge has been framed in this case, petitioner is at liberty to renew his prayer for bail. This application is, accordingly, dismissed.
