ANJANA MISHRA ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.05.2018 in connection with Kuchaikote P.S. Case No.362 of 2017 registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but only on the basis of confessional statement made before the police by one Chhote Lal Singh, the petitioner has been apprehended and is languishing in jail. It is further submitted that the petitioner has got no criminal antecedents and there has been no recovery from his possession nor has he been placed on T.I. Parade.

No.45967 of 2018 (2) dt.24-08-2018 2/2 Considering the aforementioned facts and circumstances and that the similarly situated co-accused have since been extended the privilege of bail, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikote P.S. Case No.362 of 2017.
