2. Petitioner seeks regular bail in a case, registered for the offence punishable under Section 103(1) and 3(5) of the BNS.
3. As per the prosecution case, husband of the informant was killed by unknown persons.
4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. Name of the petitioner surfaced during course of investigation due to the fact that on the alleged date of occurrence, this petitioner had telephonic conversation with the deceased several times before he had gone missing and except this there is no material to show the active
Patna High Court CR. MISC. No.78529 of 2025(2) dt.19-11-2025 2/2 participation of the petitioner in the alleged occurrence. Petitioner claims clean antecedent and he is in custody since 09.07.2025.
5. Learned counsel for the informant vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge 11th Muzaffarpur in connection with S.
