Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420 and 506/34 of the Indian Penal Code.

During business transaction, informant had supplied material to Anurag Kishan Rungta. Anurag Kishan Rungta was not paying the cost of those materials. On persistent demand of money, the petitioner, who is staff of Mr. Rungta, allegedly, threatened of dire consequences.

Submission is that the matter is of business dispute. The petitioner is in custody since 13.04.2018. Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner is a criminal and

Patna High Court Cr.Misc. No.45476 of 2018 (2) dt.02-08-2018 2/2 on the power of criminal activity of the petitioner, threat was given by Mr. Rungta through petitioner, hence, the petitioner does not deserve bail.

Petitioner has disclosed two criminal cases in para 3 of the bail petition which are cases under Sections 406 and 420 of the Indian Penal Code lodged by the same informant or his man.

Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhagalpur Kotwali Police Station Case No. 214 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
