2. The petitioner is in custody since 05.07.2022 in connection with Anti P.S. Case No. 17 of 2022 registered for the offence punishable under Sections 366(A) of the Indian Penal Code.

3. As per the prosecution case, the petitioner is involved in the kidnapping of the victim girl.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel further submits that from the statement made by the victim girl under Section 164 of the Cr. P.C., it appears that it is the victim who had gone to Kolkata from Gaya and thereafter, stayed with the petitioner.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the statement of the victim girl recorded under Section 164 Cr. P.C. and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, POCSO Cum Additional Sessions Judge, VII, Gaya in connection with Anti P.S. Case No. 17 of 2022.
