2. Petitioner apprehends their arrest in a case registered for the offence punishable under sections 303 ( 2 ) and 317 ( 2 ) of Bhartiya Nyay Sanhita ( B N S ) Act 2023 . 3 . The prosecution case in brief, is that on the alleged date and time of occurrence , some unknown persons took away the motorcycle of informant which was parked outside the house of one Dinanath Dubey.
4. It is submitted on behalf of the petitioners that petitioner is not named in the F.I.R. and the name of the petitioner transpired during course of investigation on the confessional statement of other co-accused person . No incriminating article has been recovered from the conscious
Patna High Court CR. MISC. No.83962 of 2024(3) dt.27-01-2025 2/2 possession of this petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that no incriminating articles has been recovered from the conscious possession of this petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Rohtas at Sasaram in connection with Kochas P.S. Case No. 244 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
