JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2024 The present writ petition has been filed seeking the following reliefs:- "1(a). For quashing of the order dated 6.7.2023 passed by the learned Divisional Commissioner, Patna whereby the learned Divisional Commissioner has rejected the Revision Case No-ICDS-45/2021 without considering the case of the petitioner, which is unintelligible and against the Aganbari Sevika/Sahaika Selection Guidelines 2019.

(b). For quashing of the Order dated 26.11.2019 by which the Respondent No. 5 has been appointed as Aganbari Sevika for ward No. 13

Patna High Court CWJC No.506 of 2024(2) dt.15-02-2024 2/2 and further quashing the order dt. 23.02.2021 passed by the learned District Programme Officer, Buxar in Case No.02 of 2020 whereby the District Programme Officer has dismissed the Complaint filed by the Petitioner, with regard to the appointment of the Anganwari Sevika for Ward No.13.

(c). For direction to the Respondent to restrain the Respondent No. 5 from functioning on the post of Aganbari Sevika since her appointment is illegal and against the provision of law."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law including that of filing a suit before the learned Civil Court having competent jurisdiction. Liberty, so sought, is granted. 3.
