The petitioner has been in custody since 28.05.2018 in connection with Paharpur P.S. Case No. 138 of 2018 registered for the offences punishable under Sections 147/341/323/324/ 307/354/379/506/504 of the Indian Penal Code. Learned counsel for the petitioner submits that though it is alleged that the petitioner along with others had attacked the informant, only one incised wound was found on the person of the informant which casts serious cloud on the prosecution story. It has been alleged that not only the petitioner but also Sant Kumar Thakur and Krishna Thakur had also attacked, but the injuries which are evident on his person is only single and has been found to be simple in nature.
