JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.5.2018 seeks bail in Laheri PS Case No. 124 of 2018 registered under Sections 461, 379, 411 and 414/34 of the IPC.

Learned Counsel for the petitioner submits that the allegation of committing theft is against Manish Kumar, who was apprehended on the spot along with the stolen article, only material against the petitioner is that Manish Kumar used to talk with him, however out of the three mobiles recovered his possession; one is his personal mobile and the other two are of his relatives, it has not been established during investigation that those mobiles were stolen items and the petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Salim Yusuf is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Laheri PS Case No. 124 of 2018.
