JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-05-2024 The petitioner seeks bail in connection with Sessions Trial No. 317 of 2019, arising out of Bhagwanpur P.S. Case No. 68 of 2012, instituted for the offences under Sections 302, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

2. Mr. Sabal Kumar Jha, the learned Advocate on being instructed has submitted that now the prosecution evidence at the trial against the petitioner is over and there is every likelihood of the trial being concluded in the near future.

3. As such, this Court is not inclined to direct for grant of bail to the petitioner.

4. However, looking at the period of custody of the petitioner, this Court directs that the trial ought to be concluded within a period of four months, failing which the petitioner would be entitled to pray for bail before the Trial Court and in that event, the Trial Court shall record the reasons for not concluding the trial within the afore-noted period.
