Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, Section 25(1-B)a, 26, 35 of the Arms Act as well as Section 3/5 of the Explosive Substance Act.

Petitioner is in custody since 26.07.2017. Name of the petitioner surfaced in the case on confessional statement of co-accused Shyam Sundar Kumar.

Submission is that nothing was recovered from possession of the petitioner nor the petitioner was ever put on T.I. Parade.

Though the petitioner has a very big list of

No.47990 of 2018 (2) dt.23-08-2018 2/2 criminal antecedent, however, considering the fact that there is no substantial material against the petitioner in this case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 103 of 2018 arising out of Teghra Police Station Case No. 188 of 2017, subject to the condition that both the bailors shall be personal having immovable property and resident of the territorial jurisdiction of the learned court below as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
