2. The instant application for regular bail has been filed by the petitioner in connection with Babubarhi P.S. Case No. 67 of 2022 instituted for the offence punishable under Sections 302, 304B and 120B of the Indian Penal Code.

3. It is submitted by learned counsel for the petitioner that earlier the application for regular bail of the petitioner was rejected vide order dated 01.05.2023 passed in Cr. Misc. No. 74009 of 2022 but fresh ground is that during trial six witnesses have been examined up till now including the informant and none of them have supported the prosecution case. Petitioner is

Patna High Court CR. MISC. No.84585 of 2023(3) dt.12-07-2024 2/2 in custody since 16.06.2022.

4. The application for bail is opposed by learned APP for the State.

5. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-X, Madhubani in connection with Babubarhi P.S. Case No. 67 of 2022, subject to following conditions:- (i) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court will have liberty to cancel the bail bonds of the petitioner.

(ii)The petitioner shall co-operate in the disposal of trial.
