2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 309 (4) and 310 (2) of the BNS.

3. The case of the prosecution is that unknown miscreants had looted Rs. 1,96,000/- and a mobile and a bike at gunpoint.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the Fir has been lodged against unknown miscreants and the name of the petitioner has surfaced on the basis of the confessional

No.81123 of 2025(2) dt.03-12-2025 2/2 statement of co-accused, namely, Raja It is further submitted that the petitioner was arrested from Bokaro on 21.09.2025 in Muzuffarpur Sadar P.S. Case NO. 33 of 2025 and thereafter, remanded in the present case. It is further submitted that save and except the confessional statement of co-accused, there is no material against this petitioner. Moreover, the petitioner is languishing in judicial custody since 31.05.2025 having criminal antecedent of eight cases.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Lalganj P.S. Case No. 05 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
