The petitioner is accused in connection with Mahnar P.S. Case No. 322 of 2018, registered under Sections 341, 323, 324, 326, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that in the late evening of 02.11.2018, informant, Chandan Kumar Singh, was coming to his house from Naya Pathiya Badhniya. In the way, petitioner, Suraj Kumar Singh came and asked him to withdraw the case in abusive language. When the informant made protest then he became adamant and fired through Katta causing injury at the the left side of his chest. On raising alarm, petitioner fled away
Patna High Court CR. MISC. No.72853 of 2019(3) dt.05-03-2020 2/2 and thereafter, informant was rushed at Samudaik Health Centre, Mahnar, from where, he was referred to Patna for better treatment. Thereafter, he was admitted in private hospital. Learned counsel for the petitioner submits that while occurrence is said to be taken in the evening of 02.11.2018 but the present case has been lodged on 08.11.2019 after six days of the occurrence on the basis of Fradbeyan of the informant recorded at his house. Further submission is that the injury, as found on the chest of the informant, is simple in nature. Further submission is that petitioner is accused in one another case, but in that case, he is on bail and in the present case, he is in custody since 12.11.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Vaishali, Hajipur, in connection with Mahnar P.S. Case No. 322 of 2018. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
