The petitioner seeks bail in connection with Naubatpur P.S. Case No.19 of 2019 registered under Sections 384, 386, 387, 353 and 506 of the Indian Penal Code. The accusation is that on receiving the letter of the Executive Engineer, Rural Works Department, Paliganj, regarding the demand of ransom of Rs.20,00,000/- by miscreants from the Munsi, namely, Pappu Kumar Singh, of the Contractor Luxman Kumar, for the construction of the dam, the informant along with other police personnel reached at Punpun, where the dam was being constructed and, on inquiry from the persons engaged in doing the construction work, the informant

No.73093 of 2019(3) dt.16-03-2020 2/3 came to know that on 03.01.2019 at about 11.00 A.M., the notorious criminal Jataha Singh alias Shatrughan Singh along with Bharat Singh (petitioner), Santosh Singh, Alok Kumar and some unknown having firearms came boarding on the motorcycle and asked Munshi Pappu Kumar to inform his Contractor Luxman Kumar to give ransom of Rs.20,00,000/-, otherwise asked him to stop the work. At that time, all the aforesaid persons, opened firing, due to that reason, the labourers engaged in doing the construction work moved from there.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner being the brother of Jataha Singh alias Shatrughan Singh, has falsely been implicated in this case and he is in custody since 06.04.2019. On investigation, the police has already submitted the charge-sheet against the petitioner. Mr. Pramod Kumar Singh, learned counsel appearing for the petitioner, submitted at the Bar that while the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, but in all those cases, he is on bail. He further submits that the petitioner undertakes that he will appear in the trial court on each and every date, as fixed by the trial court. Having regard to the facts and the circumstances of

No.73093 of 2019(3) dt.16-03-2020 3/3 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Danapur, Patna, in connection with Naubatpur P.S. Case No.19 of 2019. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. Further, the petitioner shall appear in the trial court on each and every date, as fixed by the trial court, failing which, the trial court would be at liberty to cancel his bail bond.
