Petitioner seeks bail in a case registered for the offences punishable under Sections 387 and 386 of the Indian Penal Code. According to FIR, ransom was demanded by video calling on WhatsApp. The informant does not claim to have identified the person, who demanded ransom. However, suspected that two persons Murari Yadav and Manish Kumar, who were already in jail, were involved in demand of ransom. Submission is that the WhatsApp number mentioned in the FIR has been shown to be of one Prakash Kumar and this petitioner. The investigation report would reveal that the said WhatsApp number was never of this petitioner. The petitioner has got criminal antecedent and for that reason the police falsely implicated the petitioner in this case. Petitioner is in custody since
Patna High Court CR. MISC. No.75449 of 2019(4) dt.18-03-2020 2/2 16.03.2019. Investigation of the case is already complete against the petitioner. There is no material to substantiate that the petitioner is going to tamper with the evidence or abscond the process of law.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rani Talab Police Station Case No. 293 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.
(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below having immovable property within the jurisdiction of the learned court below. (c) The petitioner shall not leave the country without permission of the learned trial court.
