JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2018 The petitioners are apprehending their arrest in connection with Goraul P.S. Case No. 130 of 2018, registered for offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

Allegation against the petitioners is of kidnapping minor daughter of the informant.

Submission of learned counsel for the petitioners is that Medical Board has found the age of girl about 19 years and the allegation of kidnapping is false and concocted. Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners by stating that the girl has named the petitioners in her statement recorded under Section 164 Cr.P.C. and the

Having heard both sides, in view of the above facts, I am not inclined to grant privilege of anticipatory bail to the petitioners rather they should surrender before the court below and pray for regular bail, which would be considered on its own merit. Accordingly, this application is dismissed.
