A. For issuance of an appropriate writ/writs in the nature of Mandamus PIL commanding the respondent authority to take immediate and appropriate steps for distribution of surplus land declare and vested in the State

Patna High Court CWJC No.18912 of 2025(2) dt.28-11-2025 2/3 Government by virtue of Gazette Notification dated 10-05-1983 (Annexure P/2) issued under Section 11(1) of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1962, amongst the eligible landless persons of the said village in accordance with law for which villagers representation (Annexure-P/3) is pending before the District Magistrate cum Collector, East Champaran, Motihari.

B. For issuance of direction to the respondent authority to ensure that the said vested surplus land is distributed in a transparent and lawful manner among the poor and landless persons of the concerned village who are deprived of agricultural and residential land, and further for direction upon the respondent authority to take immediate possession of the said land from illegal occupants who are continuing unlawful possession despite vesting of the said land in the State Government.

C. And for any other reliefs/reliefs for which the petitioner is found to be entitled under the provision of law involved in the present case.

2. Upon perusal of the materials available on record, it appears that the issue raised in the present writ application relates to a policy matter of the State Government. This Court does not find it appropriate to interfere with policy matters of the State Government.

3. It further transpires from the records that the petitioner himself is a beneficiary of the scheme in question. Therefore, the present writ application though styled as a Public Interest Litigation, is not maintainable.

4. Accordingly, the writ application stands dismissed.

5. Pending application(s), if any, shall also stand disposed of.
