JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 Petitioner seeks regular bail in connection with Special Case No. 7447 of 2019, registered for the offence punishable under Sections 30(a) and 37(b) of the Bihar Prohibition & Excise (Amendment) Act, 2018.
As per F.I.R. there is recovery of 25 liters of liquor from the possession of the petitioner and it appears that he is accused in a case earlier also.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He is in custody for more than 03 months. Charge sheet has already been submitted and as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the facts and

No.78335 of 2019(2) dt.02-12-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Patna, in connection with Special Case No. 7447 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
