The petitioner is apprehending his arrest in connection with Special POCSO Case No.116 of 2019 arising out of Masaurhi P.S.Case No.477 of 2019 registered for offences punishable under Sections 341, 323, 337, 354 of the Indian Penal Code and Section 12 of the POCSO Act.

As per FIR, there is allegation against the petitioner of stopping and chasing the informant and also tried to outrage her modesty. Case is under the POCSO Act.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and later on a petition has been filed by the informant before the learned court below stating that the allegation is false and concocted. Heard learned A.P.P. also.

Patna High Court CR. MISC. No.73516 of 2019(2) dt.21-11-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day.
