Petitioner seeks bail in a case registered for the offences punishable under Sections 395/397/364 of the Indian Penal Code.

This is a case of misuse of privilege of bail. Petitioner is in custody since last eight months. Submission is that this is first misuse of the petitioner and the petitioner undertakes to cooperate with the trial in future.

Considering the aforesaid undertaking, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below

Patna High Court CR. MISC. No.78788 of 2019(3) dt.09-12-2019 2/2 where the case is pending in connection with Maharajganj (G.B. Nagar) Police Station Case No.163 of 1990, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

If the petitioner would not cooperate with the trial, the learned court below shall be at liberty to cancel the bail bond and conclude the trial by putting the petitioner inside the jail.
