The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 406, 409, 420, 467 and 471/34 of the IPC and Sections 66(c) and 66(d) of the IT Act.
As per prosecution case, it appears that the amount of Lohiya Swacchta Bihar Abhiyan and Pradhanmantri Aawas Yojna (Rural) was transferred in the accounts of petitioner by hacker by manipulating soft copy of advise. It is also alleged that despite having been given notice to deposit the said amount to the government account, the petitioner has not done so. Learned counsel for the petitioner submits that petitioner has deposited the amount of Rs.89,000/- in the
Patna High Court CR. MISC. No.77787 of 2019(2) dt.29-11-2019 2/2 government treasury vide Annexure-4 of the present bail petition. He further submits that similarly situated co-accused have already been granted anticipatory bail by a coordinate Benches of this Court vide Annexure-6 series of the bail petition.
In the facts and circumstances of the case, let the petitioner above named be released on anticipatory bail in the event of her arrest or surrender in the court below within six weeks from the date of receipt of this order, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XI, Bhagalpur in connection with Pirpainti P.S.Case No.26 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
