The petitioners seek pre-arrest bail in connection with Warisaliganj P.S. Case No. 327 of 2019, pending in the Court of the Additional District Judge, II, Nawada, registered under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information of preparing the liquor at village Mohiuddinpur by the petitioner and his associate, the informant, along with other police personnel, reached there. On search of house, 600 liters semi prepared country made liquor, oven and other articles recovered. At that time four persons were apprehended who disclosed their

Submission is that petitioner was not apprehended and at the time of search of the house.

Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioners. The prayer for pre-arrest bail is rejected. The petitioners are directed to surrender before the Court below and seek regular bail, which will be considered on its own merit and without being prejudiced of this order.
