In this case, the petitioner is seeking bail in connection with Jadia P.S. Case No.132 of 2019 registered for offence punishable under sections 372, 373, 511/34 of the Indian Penal Code, sections 9/11 of the Prohibition of Child Marriage Act, 2006 and 57 of the Immoral Traffic Prevention Act, 1956.

Allegation has been made that Sushila Kumari, who is under age having 16 years, was allured for the marriage with Ajay Kumar Gautam and whereafter, she was called for marriage, but she disagreed for the marriage with Ajay Kumar Gautam, but forcefully the marriage was organized on 22nd July

Patna High Court CR. MISC. No.78681 of 2019(2) dt.04-12-2019 2/2 2019. Allegation has been made that the girl was purchased for the flash trading.

The learned counsel for the petitioner submits that the petitioner is in jail since 24.07.2019 having clean antecedent.

Looking to the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Chief Judicial Magistrate, Supaul in connection with Jadia P.S. Case No.132 of 2019, subject to the condition that one of the bailors of the petitioner shall be his parents. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (Shivaji Pandey, J) Mahesh/- U T
