Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a/26/35 of the Arms Act. Other co-accused persons were apprehended by the Police on suspicion that they were planning to commit dacoity. The name of the petitioner surfaced in their confessional statement as the person who had fled away from the place of occurrence. Co-accused, Kundan Kumar, who was apprehended by the Police has already been allowed bail by a co-ordinate Bench of this Court passed in Criminal Miscellaneous No.38853 of 2018. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Kotwali Police Station Case No.437 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
