Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 31.8.2017 passed in Cr. Misc. No. 37224 of 2017. There is recovery of 143.6 kg. Ganja. Submission of the learned counsel for the petitioner is that he is a cleaner. Only four witnesses have been examined in this case and he is in custody for more than one year. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to
Patna High Court Cr.Misc. No.46857 of 2018 (2) dt.02-08-2018 2/2 expedite the trial and try to conclude it within a period of six months, however, if the trial is not concluded during that period and there is no laches on the party of the petitioner, he shall be released on bail in connection with Special Case no.07 of 2017 arising out of DRI F No.DRI/LZU/718 (II)-Enq-10 of 2017. With the aforesaid observation, this application is disposed of.
