JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise( Amendment) Act 2016. 25 K.g of Mahua flower are said to have been recovered from the house of the petitioner but submission on behalf of the petitioner is that the alleged recovery has not been made from the house of the petitioner as it is evident from perusal of seizure list which shows that the said recovery was made from the village Dhangain and not from the house of the petitioner.

Learned counsel for the petitioner submits that moreover, petitioner does not have any criminal antecedent and

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Dhangain P.S.
