2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/34 of the Indian Penal Code.

3. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is merely witness to the sale deed and he is neither vendor nor vendee. Petitioner has not received any money in the transaction. Petitioner claims clean antecedent.

4. Learned counsel for the State as well as the informant oppose the prayer for bail.

5. Considering the aforesaid facts of the case, prayer

Patna High Court CR. MISC. No.82024 of 2023(2) dt.18-01-2024 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul, Darbhanga in Biraul Police Station Case No. 85 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
