JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending his arrest in connection with Azamnagar P.S. Case No. 157 of 2018, registered for offences punishable under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he shot dead the father of the informant.

Submission of learned counsel for the petitioner is that material collected during the course of investigation shows that petitioner and two other co-accused had fired upon the father of the informant causing his death and nobody is the eye-witness of the occurrence and other co-accused Kamal Thakur has been granted privilege of anticipatory bail by this Court by order dated 27.08.2018 passed in Cr. Misc. No. 49056 of 2018. Heard learned A.P.P. also, who has drawn the attention towards para-63 of the case dairy in which witness has disclosed

Patna High Court Cr.Misc. No.47394 of 2018(4) dt.13-09-2018 2/2 that it is petitioner who had fired upon the deceased causing his death.

Having heard both sides and in view of the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, this application stands dismissed.
