The petitioner seeks bail in a case instituted for the offences under Sections 366(A), 370, 120(B), 504 and 34 of the Indian Penal Code.
The prosecution case in short is that the accused persons forcibly abducted the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.8.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. The alleged date of occurrence is 20.5.2018 for which the case
Patna High Court CR. MISC. No.72429 of 2019(2) dt.18-11-2019 2/2 has been instituted on 5.6.2019. Merely on the basis of suspicion, the present case has been instituted. Except for suspicion, there is no other substantive evidence to suggest his implication in the present case. There is no allegation in respect to offence under Section 366A IPC in the F.I.R. On behalf of the State, it is submitted that the petitioner is named in the F.I.R..
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Motihari, East Champaran at Motihari, in connection with Govindganj P.S. Case No. 172 of 2019. (Sudhir Singh, J) Pankaj/- U T
