The petitioner apprehends his arrest in connection with Belaganj P.S. Case No. 302/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 and Section 2(e)/3/5(b)/18/42 of Mahua Full Niyamabali.

Learned counsel for the petitioner submits that it is evident that the Chawkidar of the village has falsely implicated the present petitioner as no one has seen the present petitioner to take up the Mahua flowers as has been alleged against him. He further submits that the petitioner has no criminal antecedents.

No.75131 of 2019(2) dt.02-12-2019 2/2 Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Belaganj P.S. Case No. 302/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
