JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Excise Department Case No.114 of 2019, Special (Excise) Case No. 455 of 2019, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Recovery of 7.5 liters of liquor from the possession of the petitioner. Apart from that he is accused in one more case also.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. He is in custody for three months. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence. He is ready to co-operate in disposal of the trial. Heard learned A.P.P. also.

No.76649 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Saharsa, in connection with Excise Department Case No.114 of 2019, Special (Excise) Case No. 455 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition to co-operate in disposal of the trial.
