2. The petitioner apprehends his arrest in connection with Araria (Bairgachhi) P.S. Case No. 786 of 2023, dated 08.08.2023 instituted under section 392 of Indian Penal Code.

3. As per the prosecution case, unknown criminals are said to have looted 1,15,105/-. The name of the petitioner has come during investigation.

4. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. and nothing has been recovered from the conscious possession of the petitioner. The petitioner has no criminal antecedent. The name of the petitioner has come in the confessional statement of the co-accused.

5. Learned APP for the State has opposed the prayer for bail of the petitioner and submitted that petitioner was also involved in the loot.

6. This is not a fit case for grant of anticipatory bail in which the name of the petitioner has come in the loot, this application is dismissed.

7. The petitioner is directed to surrender within four weeks and pray for regular bail.
