2. The petitioner seeks bail in a case registered for offence under Sections 396, 397, 398 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner is not the assailant of the deceased. Specific accusation is against co-accused Ajit Yadav. Petitioner has got clean antecedent and is in custody since 27.07.2024. Similarly situated co-accused Prince Yadav has been granted bail by this Court, vide order dated 09.08.2024 passed in Cr.Misc. No. 12085 of 2024 (Annexure - 4).

4. Learned A.P.P. for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Naugachia, District - Bhagalpur in connection with Bihpur (Bhawanipur) P.S. Case No. 389 of 2023.
