Petitioner seeks bail in Morkahi P.S.Case No.187of 2017 registered for the offences under Section 302/34 of the I.P.C. and Section 27 of the Arms Act.

Petitioner is named in the F.I.R. as in course of investigation on the basis of confessional statement of co-accused Manoj Sada petitioner's name transpired in this case and recovery has been effected from the other co-accused.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession. He is in custody since 21.2.2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.46696 of 2018 (2) dt.17-06-2018 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M. Khagaria, in Morkahi P.S. Case No.187 of 2017 / G.R.Case No.3616/17 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
