2. The petitioner seeks regular bail in Sonbarsa P.S. Case No. 297 of 2023 dated 26-09-2023, registered under Sections 420,467,468, 471 and 120(B) of the Indian Penal Code.
3. The petitioner is alleged to have procured his appointment on the post of Panchayat Teacher in the Madhya Vidyalaya, Pakaria Block-Sonbarsa, District Sitamarhi, on the basis of forged and fabricated certificates.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner was

No.79174 of 2025(2) dt.19-11-2025 2/3 appointed as a Panchayat Teacher in the year 2010 and at the time of verification, no objection was ever raised regarding the genuineness of his certificates. Subsequently, pursuant to the order of this Court in passed in C.W.J.C. No. 15459 of 2014 (PIL), an inquiry was conducted by the State Vigilance Investigation Bureau, wherein the genuineness of the certificates of all newly appointed teachers in Bihar was examined. During the said process, the certificates of the petitioner were found to be forged and fabricated, which ultimately led to his termination from service. Learned counsel next submits that since the petitioner has already been terminated from service, he has already suffered for the alleged misconduct.
It is further submitted that other accused persons in similar nature of cases have been granted anticipatory bail by different Co-ordinate benches of this Court vide orders dated 20-08-2025, 08-102025, and 15-10-2025 in Cr. Misc. Nos. 31064 of 2025, 27241 of 2025, and 42405 of 2025, copies of which have been annexed to the bail petition as Annexure-2 series. Learned counsel also submits that the petitioner has no criminal antecedents and has been in custody since 23-05-2025.
5. Learned Additional Public Prosecutor for the State has opposed the prayer and submitted that the appointment of
Patna High Court CR. MISC. No.79174 of 2025(2) dt.19-11-2025 3/3 the petitioner has been found to be illegal which was procured on the basis of forged and fabricated certificates.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Sitamarhi, in connection with Sonbarsa P.S. Case No. 297 of 2023.
7. The application stands allowed.
