The petitioner seeks bail in a case registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that there is recovery of 35.325 litres of country made wine from the house of the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 12.09.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail subject to deposit of Rs. 15,000/- in the court below/Nazarat on furnishing bail bond

Patna High Court CR. MISC. No.72477 of 2019(2) dt.25-11-2019 2/2 of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II, Sitamarhi in connection with Pupri Police Station Case No. 394 of 2019.

Such deposit of Rs. 15,000/- shall abide by the outcome of the pending criminal case.
