ANJANA MISHRA ORAL ORDER 27-08-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioner is in custody since 14.06.2018 & in connection with Gardanibagh P.S. Case No. 211 of 2018 for the offence registered under Section 379 of the Indian Penal Code. Learned counsel for the petitioners submits that the case was lodged against unknown persons but on the basis of the confessional statement made by co-accused, Piyush Kumar, the name of the petitioners have surfaced in connection with the present case. It is further submitted that neither any recovery has been made from the conscious possession of the petitioner nor the petitioners have been placed on T.I. Parade.

No.46755 of 2018 (2) dt.27-08-2018 Considering the aforesaid facts and circumstances of the case and that the petitioners have no criminal antecedent and name of the petitioners have surfaced on the basis of the confessional statement made before the police, which has no evidentiary value, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-XIV-cumACJM, Patna in connection with Gardanibagh P.S. Case No. 211 of 2018.
