This is an application for grant of anticipatory bail in connection with Sikandra PS case no. 109 of 2019 registered for the offences punishable under Section 354-B and other sections of IPC.

The allegation as per the fardbeyan of the informant is that on 29.04.2019 at about 6.30 pm in the evening, when he was along with his aunt, his co-villager namely Shambhu Singh i.e. the petitioner herein, came near his aunt and with ill motive, started pulling her saree, whereupon the informant is said have raised alarm and then the son of the petitioner had arrived there, armed with lathi and rod and then the accused persons had assaulted the informant and his family

Patna High Court CR. MISC. No.72843 of 2019(2) dt.27-11-2019 2/2 members resulting in infliction of various types of injuries upon the members of the prosecution party. It is the further allegation of the informant that the petitioner had hit the informant on his head by means of rod resulting in severe injury on his head and blood started oozing out.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case as also, he is having a clean antecedent. It is further submitted that the petitioner has got no complicity in the alleged crime.

I have heard the learned counsel for the parties and gone through the materials on record as also perused the FIR in question, from which it is apparent that there is specific allegation as against the petitioner of assaulting the informant on his head, hence this Court is of the opinion that the petitioner is not liable to be granted the privilege of anticipatory bail in view of the serious nature of the crime alleged to have been committed by him, thus the present petition stands dismissed.
