1. Heard the parties.

2. The petitioner has renewed his prayer for regular bail in connection with S. Tr. No. 257 / 2025 arising out of Dehri (Nagar) P.S. Case No. 232 / 2024 registered for the offence punishable under section 304(B) of the I.P.C.

3. Earlier, prayer for regular bail of the petitioner was rejected on 17.01.2025 vide Cr. Misc. No. 82052 of 2024 with liberty to renew his prayer for regular bail after nine months if the trial does not show any substantial progress.

4. It is a case of dowry death. The petitioner is husband of the deceased.

5. Learned counsel for the petitioner submits that petitioner

Patna High Court CR. MISC. No.79342 of 2025(3) dt.19-12-2025 2/3 is in custody since 21.08.2024 and trial is not likely to be concluded shortly.

This court vide order dated 21.11.2025 has called for a report from the court below regarding the present stage of the trial and in pursuance thereof learned District & Additional Sessions Judge -X, Rohtas at Sasaram has submitted his report vide letter no. 25 dated 28.11.2025. From perusal of the same it appears that charges have been framed against the petitioner and others on 12.11.2025 and out of nine charge sheet witnesses none has been examined by the prosecution.

7. Taking into consideration the fact that this is second attempt for bail on behalf of the petitioner, the petitioner has remained in custody for about 01 year 04 month and trial is not likely to be concluded in near future, accordingly, I am inclined to grant regular bail to the petitioner.

8. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs.20,000 /- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-10, Rohtas at Sasaram in connection with S.Tr. No. 257 / 2025 arising out of Dehri (Nagar) P.S. Case No. 232 of 2024 subject to the condition that the petitioner shall remain present before the trial

Patna High Court CR. MISC. No.79342 of 2025(3) dt.19-12-2025 3/3 court on each and every date and in case of default on two consecutive dates with prior permission his bail bond shall liable to be cancelled.
