2. Petitioners seek regular bail in case registered for offence under Sections 103 (1) , 61 ( 2 ) and 3 (5) of BNS. 3 . As per prosecution case, informant namely, Manish Kumar alleged that on 07.04.2025 at about 06:30 PM, brother of informant, informed through his mobile that his mother has been killed by slitting her neck . Upon such information , when he reached home , he saw her dead body was lying and blood was oozing out of body . Informant suspects that due to land dispute , all the F.I.R. named accused persons including this petitioner killed the mother of informant.

4. Learned counsel for the petitioners submitted that from bare perusal of F.I.R. it is apparent that informant is not an eye witness to the alleged occurrence . Only suspicion has been raised against this petitioner because of longstanding land dispute between the parties. During course of investigation , brother of informant has also not disclosed as to how he came to know about the involvement of this petitioner in the alleged occurrence . Petitioners claim clean antecedent and is in custody since 08.04.2025 .
5 . Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts, period of custody , clean antecedent of these petitioners and circumstances of the case , let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Sessions Judge - V Katihar in connection with Barari PS Case No. 94 of 2025 .
