2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 309(4) of the B.N.S.
3. The case of the prosecution is that the petitioner along with other took away rupees fifty thousand from the pocket of the informant on knife point. One boy who was present at that time namely, Dinesh Sahni has identified this petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He submitted that from the
Patna High Court CR. MISC. No.85868 of 2024(3) dt.21-03-2025 2/2 possession of this petitioner one knife and eighteen hundred rupees have been recovered. It has been submitted that there has been no TI parade however, as he has been identified at the place of occurrence, the question of TI parade does not arise. Moreover, he is languishing in judicial custody since 09.07.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that petitioner has one criminal antecedent.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kaluahi P.S. Case No. 124 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani.
