The petitioner seeks bail in a case registered for the offence punishable under Sections 279, 307, 188, 504 and 506 of the Indian Penal Code and Section 37 (B) of the Bihar Prohibition and Excise Act, 2016.

Petitioner in inebriated condition tried to dash the vehicle of the police and on apprehension he slated and given threat to the police personnel.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. No such occurrence as alleged took place. He has been falsely implicated in this case by

Patna High Court Cr.Misc. No.47436 of 2018 (2) dt.03-08-2018 the police due to some altercation between them on his refusal to cough up the demand of graft made by them. He happens to be a teetotaler and had never consumed liquor. He has no criminal antecedent and has been languishing in custody since 20.06.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge, Jamui in connection with Khaira P.S. Case No. 230 of 2018.
