JUSTICE BIRENDRA KUMAR ORAL ORDER 10-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offence punishable under Section 436 of the Indian Penal Code. Some unknown committed mischief by fire in the shop of the informant. Subsequently, on the basis of CCTV footage, the petitioner was suspected to be the real culprit for the reason that the petitioner was employee of the informant and he had grudge against the owner of the shop. Petitioner is in custody since 28.03.2018. Investigation of the case is complete. Petitioner has got no criminal antecedent.
Learned counsel for the informant opposed the prayer on the ground that there is direct allegation against the
Patna High Court Cr.Misc. No.47392 of 2018 (2) dt.10-08-2018 P2/ petitioner and against no other.
Considering the aforesaid material and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kotwali (Jogsar) P.S. Case No.198 of 2018, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
