Petitioner prays for bail in connection with Kudra P.S.Case No. 238 of 2018 registered for the offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the informant by knife and caused injuries to him. Submission of learned counsel for the petitioner is that there is case and counter case between the parties and petitioner has also received injuries and he was under treatment at Varanasi and he is in custody since 21.6.2018.

Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.47646 of 2018 (3) dt.20-09-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed and trial commenced, learned trial court shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
