The petitioner has been in custody since 31.05.2019 in connection with Pothia P.S. Case No. 109/2019 registered for the offence punishable under Sections 341/323/302/307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the plain reading of the FIR itself reveals that the petitioner has not been ascribed any specific role in the entire occurrence. The only allegation against the present petitioner is that he was present at the place of occurrence. Learned counsel for the petitioner thus submits that the petitioner may be extended the privilege of regular bail as he has not committed any overtact which stands testified by the FIR itself.
