JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2018 The petitioner is in custody since 07.01.2018 in connection with Sessions Trial No. 162/2018 arising out of Bijaipur P.S. Case No. 01 of 2018, registered for offences punishable under Sections 341, 323, 307, 504 and 302 of the Indian Penal Code.
Allegation against the petitioner is of giving farsa blow to the husband of the informant and during treatment in hospital, he died.
Submission of learned counsel for the petitioner is that there was single blow to the deceased and moreover he has falsely been implicated in this case. Further submitted that the deceased was an old person and due to felt down, he received injury and petitioner is in custody since 14.06.2017 and there is no likelihood

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail of the petitioner stating that the deceased was assaulted by farsa and when his daughter came to save him, she also assaulted. Having heard both sides and considering the aforementioned facts and circumstances as stated above, I am not inclined to grant privilege of bail to the petitioner, however, since the charged is framed, learned Trial Court is directed to expedite the trial.
Accordingly, this application is dismissed.
