JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending his arrest in connection with Barabar Paryatan (Bishunganj OP) P.S. Case No. 45 of 2018, registered for offences punishable under Section 395 of the Indian Penal Code.

Allegation, as per the FIR, in short is that the police seized three tractors carrying illegal sand and it is alleged that petitioner along with other co-accused persons assaulted the cook of the informant and also snatched his personal motorcycle.

Learned counsel for the petitioner submits that no specific allegation against the petitioner has been attributed and his name has come along with 10-12 persons only on suspicion. Heard learned A.P.P. also.

Having heard both sides and considering the facts and

No.48455 of 2018(3) dt.13-09-2018 2/2 circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Mr. Umesh Prasad, J.M. 1st Class, Jehanabad in connection with Barabar Paryatan (Bishunganj O.P.) P.S. Case No. 45 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
