2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 406, 467, 468, 323, 379, 504, 506 and 34 of the Indian Penal Code.
3. Allegation against co-accused persons along with this petitioner is that they committed cheating after taking Rs. 90 lacs from the informant for the purpose of executing the sale deed of the house.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.81933 of 2023(3) dt.15-01-2024 2/3 the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted from para-8 of this petition that petitioner has been made accused in this case simply because he happens to be brother of one Ajay Singh. It will be evident from FIR that informant entered into an agreement with one Rina Devi in which her two husbands, namely, Mukesh Kumar Singh and Ajay Singh put their signature and she alleged stated that she gave Rs. 3,50,000/- cash and Rs. 50,000/- through cheque to Rina Devi. Petitioner has no role in this alleged offence. He has not received any amount from the informant and also he lives separately from his brother, Ajay Singh since 2005. Moreover, he is languishing in judicial custody since 18.09.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Phulwarisharif P.S. Case No. 791 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
